These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("User," "you") and DO U EVEN LIFT LLC, an Ohio limited liability company ("Company," "we," "us," "our"), governing your access to and use of the DUEL platform, including the website at douevenlift.com, the web application at app.douevenlift.com, and any related mobile applications (collectively, the "Service").
By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not access or use the Service.
You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are between 16 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. One account per person. Anonymous accounts are not permitted.

We reserve the right to investigate and take appropriate action, including suspension or termination of your account, for violations of these Terms.
DUEL offers both free and paid subscription tiers. Paid subscriptions ("Pro," "Coach," "Club") are billed on a recurring monthly basis at the rates displayed at the time of purchase. All fees are in U.S. dollars.
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds will be issued for partial billing periods, except as required by applicable law or at our sole discretion.
We reserve the right to modify pricing with 30 days' advance notice to active subscribers.
You retain ownership of all workout data, profile information, and other content you submit to the Service ("User Content"). By submitting User Content, you grant DO U EVEN LIFT LLC a worldwide, non-exclusive, royalty-free license to use, store, display, and process your User Content solely for the purpose of operating and improving the Service.
Leaderboard Data: Display names, gym affiliations, strength scores, and duel records are visible to other users as part of the core competitive functionality of the Service. By participating in leaderboards and duels, you consent to this public display.
Aggregated & De-Identified Data: We may create anonymized, aggregated, and/or de-identified datasets derived from User Content and usage data. These datasets do not identify individual users and may be used, shared, or sold for research, analytics, industry benchmarking, or commercial purposes. See our Privacy Policy for full details.
A core feature of DUEL is the concept of a permanent lifting record. By using the Service, you acknowledge and agree that:
The Service, including all content, features, functionality, branding, trademarks, logos, and code, is owned by DO U EVEN LIFT LLC and is protected by U.S. and international copyright, trademark, and other intellectual property laws. "DUEL" and "Do U Even Lift" are trademarks of DO U EVEN LIFT LLC.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not guarantee the accuracy of strength score calculations, leaderboard rankings, or duel outcomes.
TO THE MAXIMUM EXTENT PERMITTED BY OHIO LAW AND APPLICABLE FEDERAL LAW:
EXERCISE WARNING: DUEL is a fitness tracking platform, not a medical service. Consult a physician before beginning any exercise program. You assume all risk of physical injury associated with your use of the Service.
You agree to indemnify, defend, and hold harmless DO U EVEN LIFT LLC, its officers, directors, members, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
We may suspend or terminate your account at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users, or is otherwise objectionable. Upon termination, your right to use the Service ceases immediately.
These Terms are governed by and construed in accordance with the laws of the State of Ohio, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Huron County, Ohio. You consent to the personal jurisdiction of such courts.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and DO U EVEN LIFT LLC regarding the Service and supersede all prior agreements and understandings.
